Terms and conditions

These terms govern the use of intervolutions.com and of the services we offer through it: the contact and quote forms, the newsletter and job applications. By using them you accept what this page says. Who we are and who owns the site is in the legal notice; what we do with your data is in the privacy policy.

What this site is and isn't

• The site is informational and commercial: it explains what we do, shows our work and lets you get in touch.
• It's not a store. Nothing is paid for here, nothing is contracted here, and sending a form neither buys nor reserves anything.
• The technical articles are published in good faith and may become outdated. They are general writing, not advice for your specific case.

Quotes and proposals

• The figures shown on the site and in the estimator are ballpark estimates. They exist to give you an order of magnitude before we talk; they are not an offer or a fixed price.
• Sending the quote form creates no obligation for either side: you are not committing to hire us, and we are not committing to take the work.
• If the project fits, we send a formal proposal with scope, a milestone schedule and a price. That proposal is valid for 30 days from its date, and only what it contains binds us.
• Engagements are formalized in a separate contract. Nothing said on this site, in the estimator or in an earlier email replaces that contract: where they conflict, the signed contract prevails.

Response times

We aim to reply within 1–2 business days, and we almost always do. It is a service target, not a contractual guarantee: a busy spell, a local holiday at either of our two offices or a mail outage can stretch it. If it is urgent, say so in your message.

Using the forms

• The information you send must be truthful and yours, or you must have permission from whoever it belongs to.
• The forms may not be used for unsolicited advertising, for unlawful or offensive content or content that infringes third-party rights, or to attempt to overload or compromise the service.
• We apply anti-abuse measures and submission limits, and we may discard automated or spam-looking submissions without notice. If you have not heard back within 48 hours, email [email protected] and we will look into it.
• Please do not send sensitive data (health, beliefs, union membership and the like) or access credentials to your systems through these forms. If the project needs them, we will ask through an appropriate channel.

Newsletter

• Subscribing is voluntary and only requires your email address.
• You can unsubscribe at any time by emailing us; once issues go out, each one will carry an unsubscribe link. It takes effect immediately and needs no explanation.
• We send our own content about what we build and learn. We do not share the list or use it to advertise third parties.

Job applications

• When you apply for a role you send us your professional details and, if you attach one, your résumé. We use them only to assess your application for that process.
• Send only information that is yours and that you are free to share. Do not include third-party data, confidential documentation from another employer, or sensitive data the role does not require.
• Posting an opening doesn't obligate us to fill it, and we may close a search at any time.

How long we keep your application and how to ask us to delete it is set out in the privacy policy.

What you send us

What you send stays yours. We acquire no rights over your ideas, your documentation or your material.

You authorize us only to read it, store it and handle it internally in order to reply, prepare the proposal or assess your application. Nothing else: we do not publish it, show it in our portfolio or use it as an example without asking you first.

Intellectual property

The code, text, design and other elements of the site belong to Tombatossals Softworks LLC or to third parties who authorized their use. The full terms are in the legal notice.

Availability and changes to the site

We work to keep the site available and up to date, but there may be interruptions for maintenance or incidents, and we may change, move or withdraw content and features without notice.

For sites hosted on our care plans we commit to 99.9 % monthly uptime, measured by the automated check that runs every minute and calculated per calendar month. That is about 43 minutes of downtime a month. Excluded from the calculation: planned maintenance announced in advance, force majeure, failures in third-party services we do not administer — your domain, your payment gateway, your mail provider — and anything caused by a change made to the site by somebody other than us. If we miss it in a given month, you hear it from us with the incident log in hand; you do not have to claim it.

External links lead to sites we do not control. We are not responsible for their content or their terms.

Liability

We are liable for damage we cause through willful misconduct or negligence in providing our services, to the extent the law provides. We are not liable for damage arising from misuse of the site, from decisions based solely on its informational content, or from temporary unavailability. None of this excludes or limits liability that cannot lawfully be excluded, including any rights you have as a consumer.

Changes to these terms

We may update these terms when our services or the law change. The applicable version is the one published here at the time you use the site, and the date above says when it was last reviewed. If a change matters to someone with a live proposal, we tell them.

Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Castellón de la Plana (Spain).

If you are acting as a consumer, this clause takes nothing away from you: you may always bring proceedings before the courts where you live, and the mandatory consumer-protection rules of your country still apply to you.

For clients in the United States, each engagement is governed by the contract we sign, which states the applicable law and venue.
